Posting Student Photos on the Web

What students are to be excluded from any photos … period?

  1. Any students who are under DHS custody
  2. Any students whose parent/guardian has signed an ‘opt out’ form requesting their child not be included in any directory information
  3. Students whose parent/guardian has denied permission on a Talent Release form

* Special Needs students require a signed talent release. Also, photos should be made available for parental/guardian approval before posting.

When a parent/guardian ‘opts out’ of directory listings – does the form remain permanently in effect, even if the parent/guardian subsequently signs a talent release?
If a talent release form is signed after the opt-out form is signed, the talent release form overrides the opt-out and student pictures may be used online.  Otherwise, the 'opt-out' form does not expire.

Should schools hand out talent releases at the beginning of each year?
No. Talent Releases should only be used when needed.

When posting on a school/department website, do I need a signed talent release in the following circumstances?
  • I am highlighting and identifying (first and last name) a particular student and their work.
Yes, you will need a talent release for the photo of the student. You will also need a separate form signed by the parent giving permission to display the student’s work online. (See Fair Use / Copyright section)
  • I want to take a photo of a class and identify every student with first and last name.
No. However, it is strongly suggested that you use first names only.
  • I want to take a photo of a sports team and identify every student with first and last name.
    No
  • I want to take a photo of a club and identify every student with first and last name.

I want to take a picture of a school assembly – do I have to find DHS and opt-out students in the crowd and airbrush them out?
